Deliveries & Returns

We are pleased to welcome you to our website (hereinafter referred to as the "site"). This site is an information and e-commerce site accessible via the internet and open to any user (hereinafter referred to as the "customer") on which the company Energie Van & Boat (hereinafter referred to as "Energie Van & Boat").

For the application of these general conditions of sale, it is agreed that Energie Van & Boat and the customer will be collectively referred to as the “Parties”.

Any order for a product offered on the site requires the consultation and acceptance of these general terms and conditions of sale by the customer. As a result, the order cannot be validated without the customer having checked the box "I certify that I have read these general terms and conditions of sale, which I accept".

Consequently, placing an order implies the customer's full and unreserved acceptance of these general terms and conditions of sale. Energie Van & Boat reserves the right to correct the content of these terms and conditions at any time and without notice.

It is understood that these general conditions of sale remain valid, notwithstanding any modifications made, for all orders in progress on the day of said modifications. If a condition were to be lacking, it would be considered to be governed by French customs and laws in force in matters of distance selling.

If one or more provisions of these general terms and conditions of sale are held to be invalid or declared as such pursuant to a law, regulation or following a decision of a competent court, the other provisions shall retain their full force and scope. The customer may save or print these general terms and conditions of sale, provided however that they are not modified.

Object

These general terms and conditions of sale govern the sale of “Energie Van & Boat” items on the site by the company Energie Van & Boat Siret 95236180600013 to all non-commercial, adult individuals exclusively (hereinafter referred to as the “customer”).

Price

Prices are indicated in Euros, all taxes included and for the territories concerned, excluding participation in shipping costs which will be communicated when the order is validated.

Prices are applicable during the period of validity mentioned on the commercial offer. They are established according to the economic conditions in force when the commercial offer is established. They may be revised or modified at any time. These modifications, with the exception of those relating to fiscal and parafiscal taxes, will only be applicable to orders validated after this one.

Any order placed and delivered outside of France may be subject to possible taxes and/or customs duties upon arrival at the destination. These possible customs duties and/or taxes related to the delivery of the order are the responsibility of the customer. Energie Van & Boat is not required to check and inform the customer of the duties and taxes applicable in the destination country.

Order

Automated order recording systems are considered to constitute proof (not irrefutable) of the nature, content and date of the order.

Any acceptance of an order constitutes an irrevocable acceptance that can only be challenged within the limits provided for in these general terms and conditions of sale and by law. The customer acknowledges having read, at the time of placing the order, the specific terms and conditions of sale set out in these terms and conditions, and expressly declares that they accept them without reservation.

The order will only be taken into account once the payment has been validated by the customer on the site. The REVOLUT service will confirm to the customer that the order has been processed and the payment has been validated, to the email address that the customer has provided. Following payment, a summary document of the order is sent by Energie Van & Boat to the Customer, by email to the email address provided by the latter, immediately and at the latest before delivery.

This document, which serves as an acknowledgement of receipt of the Customer's order, includes all the elements constituting the contract between the parties. The customer will have the option of printing the summary order form sent by email. The customer will be able to follow the progress of their order at any time on the site in the "My Account" section or contact Customer Service by email: boutique@ventdesud-biarritz.fr for any questions relating to their order.

Energie Van & Boat reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order, but also in the event of unavailability of the products ordered. In the latter case, the Company will inform the customer by email as soon as possible and will refund the price charged by crediting the customer's bank card.

The information provided by the customer when placing the order is binding on the customer. In the event of an error in the wording of the recipient's contact details, Energie Van & Boat cannot be held responsible for any consequences that this error may cause.

The customer accepts that any order placed on Friday from 11 a.m. or the day before a public holiday can only be processed from either Monday or the day after the public holiday.

Delivery

Energie Van & Boat undertakes to implement the necessary efforts to ensure that the advanced delivery times are respected. However, a delay in delivery cannot result in the cancellation of the order, nor any right to compensation for the benefit of the Customer. 

Ownership of the goods ordered will only be transferred to the customer after full payment of the invoiced price, including delivery costs.

Claim

In the event of partial loss or damage upon delivery, the customer must make a reasoned complaint sent by registered letter with acknowledgement of receipt to our customer service at the address of the company Energie Van & Boat within three days of receipt of the products ordered. He must also issue all reservations to the carrier (clear, precise and detailed reservations) and indicate all apparent anomalies noted upon delivery on the delivery slip. Failing this, he will not be able to claim any compensation.

In the event of a total loss, the customer must make the same claim to our customer service department.

In case of non-conformity of the product delivered with the order, the product may be refused, at no additional cost to the customer or returned to our customer service in perfect condition and in its original packaging and packaging. It will be exchanged, at no additional cost to the customer.

Withdrawal period

In accordance with article L 121-20 of the consumer code, the customer has a period of 14 working days from receipt of the products to return, at his own expense, the items ordered which do not give him satisfaction.

Only products returned in their original packaging, complete and intact, and in perfect condition for resale will be accepted. Any product that has been damaged, as well as any product made to measure for the customer or any footage cut to the measurement specified by the customer will not be accepted.

This right of withdrawal is exercised without penalty, with the exception of return costs. Any claims made after the 14-day period, other than those made under the legal guarantees to which Energie Van & Boat is subject, will be rejected and the company will be released from its liability.

Under no circumstances can the products be returned to the store.

If the above conditions are met, the customer will be reimbursed within thirty days from the date of receipt of the package by Energie Van & Boat, based on the amounts paid by the customer, excluding return costs and taxes and/or customs duties mentioned in the price article.

Any claim made after the seven-day period, other than those made under the legal guarantees for which Energie Van & Boat is bound, will be rejected and Energie Van & Boat will be released from its liability.

Secure Payment

Payment will be made, unless the server is unavailable, immediately on the Internet, by payment card issued in France or abroad by Carte Bleue, Visa and Eurocard/Mastercard, via the website of our banking partner REVOLUT.

Energie Van & Boat reserves the right to refuse any order or delivery in the event of an existing dispute with the Buyer, total or partial non-payment of a previous order by the Buyer, refusal of authorization of payment by credit card by banking organizations, non-payment or partial payment. The responsibility of Energie Van & Boat can then in no case be engaged.

The bank card transaction, carried out between the Buyer's computer and the secure system of the REVOLUT partner for online payment, is fully encrypted using the SSL (Secure Socket Layer) process and protected.

Liability and Force Majeure

Energie Van & Boat has only an obligation of means for all stages of access to the site, from the ordering process to delivery. Energie Van & Boat cannot be held liable for any damage inherent in the use of the Internet, in particular a service interruption, an external intrusion or infection by computer viruses.

Energie Van & Boat cannot be held responsible for the total or partial non-performance of its obligations under this contract, if the origin of this non-performance is a case of force majeure or similar, in particular in the event of disruption or strike (in particular postal services, means of transport and communication), fire, flood, and generally in the event of events beyond its control.

Beyond a period of thirty days of interruption of deliveries due to force majeure or similar, Energie Van & Boat reserves the right not to honor the order, on condition that it reimburses the customer within thirty (30) days following the cancellation.

Information technology and freedoms

All texts, comments, photos, brands, graphics, concepts, illustrations and images composing the Site are the exclusive property of Energie Van & Boat and are protected by intellectual property rights in France and throughout the world. Any total or partial reproduction of the Site is strictly prohibited.

The provision of personal information collected for the purposes of distance selling is mandatory, as this information is essential for processing and delivering orders and issuing invoices. Failure to provide this information will result in the order not being validated.

To make purchases on the site, the Customer must create an account, choose an email address and a password that will be requested each time they wish to access it. The Customer's personal information is thus protected by a password so that the Customer, and only the Customer, has access to it. Energie Van & Boat recommends not disclosing it to anyone. The Customer must also log out of their profile and close their browser window at the end of each work session, particularly when the Customer uses shared computer equipment. The customer will thus prevent users from accessing their personal information. The Customer is solely responsible for their password. The customer will bear the consequences of any fraudulent use of their password.

In accordance with the "Informatique et Libertés" law of 6 January 1978, the processing of personal information relating to customers has been declared to the National Commission for Information Technology and Civil Liberties (CNIL). The customer has (Article 34 of the law of 6 January 1978) a right of access, modification, rectification and deletion of data concerning him, which he can exercise with Energie Van & Boat

Furthermore, Energie Van & Boat undertakes not to communicate, free of charge or for consideration, the contact details of its customers to a third party. However, it may use these contact details for itself or for companies in the same group.
